Erec Rolfe
PRINCIPAL LAWYER
Erec Rolfe is a Toronto criminal lawyer who defends clients facing charges throughout the GTA and beyond. He has over 10 years’ experience as a criminal lawyer, and consistently and successfully defends a multitude of serious offences. Erec has conducted complex and challenging trials and appeals on a wide variety of criminal charges at all levels of court in Ontario.
Erec’s advocacy has made a significant impact to the law, affecting the lives of thousands of people across the province, well beyond his own clients. For example:
- Erec was lead counsel in R. v. Duncan, 2016 ONCA 754, the case that paved the way for thousands of offenders to be granted extra credit (now known as “Duncan Credit”) for harsh jail conditions, including “lockdowns” and other inhumane conditions. Trial judges rely on R. v. Duncan every day, across the province, and offenders serve shorter jail sentences as a result.
- Erec was lead counsel in R. v. Meads, 2018 ONCA 146, where the Ontario Court of Appeal struck down a law that prevented judges from providing extra credit for time served in jail, when they were alleged to have breached bail conditions. The court declared the law unconstitutional and it is no longer in effect.
Erec graduated from Dalhousie Law School in 2007 where he graduated on the Dean’s List. He also won the Hanson Prize for highest standing in Constitutional Law as well as the prizes for highest standing in International Law, Conflicts of Laws and Property Law.
Before practicing criminal law, Erec practiced in commercial litigation at a major Toronto law firm where he represented clients at all levels of court in Ontario. He also completed a portion of his articling year with Eddie Greenspan, Q.C., where he played a pivotal role in overturning the conviction of an accused who had not received a fair trial.

Ethan Garber
ASSOCIATE
Ethan Garber is an associate lawyer at Erec Rolfe Criminal Defence.
Ethan completed law school at Osgoode Hall, after completing an Honours degree at the University of Toronto. Prior to joining the firm, he completed his articling year at a well-respected criminal law firm in Toronto. There, he played a critical role in developing the defence in a high-profile murder case, in addition to assisting with appeals for Innocence Canada.
As a lawyer, Ethan has experience working on trials in cases involving drug trafficking and firearm offences, assault, impaired driving and human trafficking, among others.
Ethan is dedicated to guarding the constitutional rights and dignity of those facing criminal charges and works hard to obtain the best possible outcomes for his clients.
